Educator Platform Terms of Use

1. Purpose of the Platform

The Platform is intended solely to help educators and other authorized users provide scholarship-related information and assist others with:

• Finding scholarships and educational funding opportunities
• Reviewing scholarship eligibility requirements
• Organizing scholarships and application deadlines
• Receiving scholarship reminders and guidance
• Accessing resources related to the scholarship process

The Platform may not be used for unrelated commercial, promotional, political, personal, or organizational purposes.

2. Authorized Users

The Platform is available to educators, counselors, advisors, administrators, mentors, and others authorized to provide scholarship-related assistance.

By creating an account, you represent that:

• Your account information is accurate
• You are authorized to use the Platform in the stated capacity
• You will use the Platform only for its intended purpose
• Your use complies with applicable laws and institutional policies
• You will protect your login credentials from unauthorized use
• You will notify us promptly of suspected unauthorized access

You are responsible for activity conducted through your account.

3. Contact Information

The Platform may allow you to add email addresses or other limited contact information for individuals with whom you wish to communicate.

You may provide contact information only when:

• You are authorized to use it for scholarship-related communications
• The intended recipient is at least 13 years old
• Any required notice has been provided
• Any required consent has been obtained
• Providing the information complies with applicable laws and institutional policies

You may not provide personal information other than the limited contact information expressly permitted by the Platform.

4. User Responsibilities

You and, when applicable, your institution are responsible for:

• Complying with applicable privacy and education laws
• Following institutional policies governing contact information
• Maintaining accurate and current contact information
• Removing individuals who should no longer receive communications
• Honoring requests to stop communications
• Reviewing information before sharing it
• Maintaining appropriate control over your account

These responsibilities may include compliance with the Family Educational Rights and Privacy Act ("FERPA") and other student privacy requirements.

Nothing in these Terms authorizes you to provide information that you or your institution are otherwise prohibited from providing.

5. Permitted Communications

Communications sent through the Platform must relate directly to scholarships or scholarship assistance. Permitted communications may include:

• Scholarship opportunities
• Scholarship lists
• Eligibility and application information
• Application deadlines and reminders
• Scholarship-related events and resources
• Application guidance
• Information about organizing or managing applications

Communications may identify you or your associated school, institution, or organization and may indicate that Scholarships.com facilitated their delivery.

6. Prohibited Uses

You may not use the Platform to:

• Send communications unrelated to scholarships or scholarship assistance
• Advertise unrelated products, services, events, or organizations
• Send spam, deceptive messages, or unsolicited commercial communications
• Harass, threaten, discriminate against, or impersonate another person
• Provide false, misleading, unlawful, or harmful information
• Collect or use recipient information for an unauthorized purpose
• Share account credentials or permit unauthorized access
• Interfere with the operation or security of the Platform
• Access accounts, information, or systems without authorization
• Scrape, extract, or distribute Platform information using automated methods
• Violate intellectual property, privacy, or other legal rights
• Use contact information outside the Platform for an unauthorized purpose

You may not use the Platform to provide:

• Information concerning a child under 13
• Social Security numbers or government identifiers
• Financial account or payment information
• Grades, transcripts, or disciplinary records
• Health, disability, or medical information
• Information about race, ethnicity, religion, or sexual orientation
• Passwords or account credentials
• Scholarship application responses or supporting documents
• Any personal information other than permitted contact information

7. Scholarship Information

You are responsible for reviewing scholarship information before sharing it and confirming that your communications are appropriate for their intended recipients.

Scholarship requirements, deadlines, award amounts, and availability may change. Scholarships.com does not guarantee that scholarship information is complete or current or that any individual will qualify for, apply for, or receive an award.

Users and recipients should verify important information directly with the scholarship provider.

8. User-Provided Content

If you enter, organize, or share content through the Platform, you represent that:

• You have the right to use and share it
• It is related to the permitted purpose of the Platform
• It does not violate applicable law or another party's rights
• It is not knowingly false, misleading, or deceptive

You grant Scholarships.com permission to store, process, reproduce, format, and transmit the content as reasonably necessary to operate the Platform.

You retain any ownership rights you have in the content you provide.

9. Platform Ownership

The Platform and its software, design, branding, functionality, and original content are owned by Scholarships.com or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to use the Platform for its intended purpose. No other rights are granted.

10. Monitoring and Enforcement

We may monitor Platform activity and maintain records as reasonably necessary to:

• Operate and secure the Platform
• Investigate technical or delivery issues
• Prevent unauthorized access or misuse
• Respond to complaints
• Enforce these Terms
• Comply with applicable law

We may remove information or restrict, suspend, or terminate an account if we reasonably believe that these Terms, applicable law, or another person's rights have been violated.

11. Third-Party Services

Scholarship information may include links to websites or services operated by third parties. Scholarships.com does not control and is not responsible for their content, availability, security, terms, or privacy practices.

Users and recipients should review third-party terms and privacy policies before providing information or submitting an application.

12. Platform Availability

We may modify, suspend, discontinue, or limit any Platform feature at any time. We do not guarantee:

• Uninterrupted or error-free access
• Successful delivery of every communication
• Recipient engagement or response
• The accuracy or availability of scholarship information
• Eligibility for or receipt of any scholarship

The Platform is an informational resource and does not replace the independent judgment or professional responsibilities of its users.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis. Scholarships.com disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and noninfringement.

Some jurisdictions do not permit certain warranty limitations, so portions of this section may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, Scholarships.com will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

• Access to or use of the Platform
• Inability to access or use the Platform
• Communications sent through the Platform
• Scholarship information or third-party services
• Unauthorized account access
• Loss or misuse of information
• Suspension or termination of an account

Nothing in these Terms excludes liability that cannot legally be excluded.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Scholarships.com and its officers, employees, and representatives from claims, damages, obligations, losses, and expenses arising from:

• Your use or misuse of the Platform
• Information or content you provide
• Communications you send
• Your violation of these Terms
• Your violation of applicable law or another party's rights
• Your failure to obtain required authorization or consent

This obligation does not apply where prohibited by law.

16. Changes to These Terms

We may update these Terms to reflect changes in the Platform, our practices, or applicable requirements.

When appropriate, we will provide notice of material changes through the Platform, by email, or by updating the effective date. Continued use of the Platform after revised Terms become effective constitutes acceptance of those Terms.

17. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute must be brought in a court of competent jurisdiction located in or serving Lake County, Illinois, except where applicable law requires otherwise.

18. Severability and Waiver

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision does not waive our right to enforce it later.

19. Entire Agreement

These Terms constitute the complete agreement between you and Scholarships.com concerning use of the Educator Platform and supersede prior discussions or agreements concerning that use.
